(hereinafter referred to as the "Company" or the "Seller")

issues these Terms and Conditions, which govern the rights and obligations between the Company and customers in connection with the provision of accommodation and accompanying services at the Golden Peacock Resort in Sri Lanka.

1. Introductory Provisions

1.1. These Terms and Conditions govern the contractual relationships between customers and Golden Peacock Resort CZ s.r.o., Company ID: 19990341, with registered office at Riegrova 394/17, 779 00 Olomouc, Czech Republic (hereinafter referred to as the "Company" or the "Seller"), registered at the Regional Court in Olomouc, Section C, Insert 94494.

1.2. The Company arranges leisure services for customers through its partner company Golden Peacock Resort (PVT) Ltd., Reg. No. PV00284175, with registered office at No. 56, Sonuththara Road, Bentota, Sri Lanka, which operates the Golden Peacock Resort.

1.3. Service reservations are made through the website www.goldenpeacockresort.com.

2. Scope and Nature of Services Provided

2.1. Golden Peacock Resort CZ s.r.o. offers customers leisure services at the Golden Peacock Resort in Sri Lanka via the website www.goldenpeacockresort.com.

2.2. The services include in particular:

• accommodation,
• catering,
• wellness, yoga and ayurvedic treatments,
• themed tours and excursions in Sri Lanka,
• additional services within the resort.

2.3. The services are provided in person at the resort in cooperation with local partners, with the contract for service provision concluded in the Czech Republic with Golden Peacock Resort CZ s.r.o.

2.4. The customer is obliged to read these Terms and Conditions before concluding the contract. By concluding the contract, the customer confirms agreement with the Terms and Conditions.

3. Contract Conclusion, Reservation and Payment

3.1. Customers may reserve services via e-mail, contact form, or telephone.

3.2. The reservation is considered binding after payment of a deposit of 30–100% of the total price of the ordered services.

3.3. Payment can be made:

• by bank transfer to the EUR account no. 2503002584/2010 (IBAN: CZ3020100000002503002584),
• in cash at the resort (in EUR or USD),
• by VISA or Mastercard credit card (on-site; subject to a 3% fee).

4. Cancellation Policy and Reservation Changes

4.1. The customer may cancel the reservation according to the following cancellation conditions:

4.2. A change of the paid reservation date is possible no later than 31 days before the start of the stay and only subject to availability.

4.3. The customer shall pay the difference in price (in the case of a higher rate); any overpayment will not be refunded.

4.4. Cancellations must be made in writing (by email) or by phone. If the reservation is not canceled, the full price of the stay will be charged.

5. Liability and Complaints

5.1. Complaints about the provided services may be submitted in writing or orally to the resort staff or to the Company’s email.

5.2. The Company undertakes to handle the complaint without undue delay, no later than 30 days from its assertion.

5.3. The Company shall not be liable for circumstances caused by force majeure (e.g. natural disasters, political events, health restrictions, etc.).

6. Personal Data Protection and Processing

6.1. Golden Peacock Resort CZ s.r.o., with its registered office at Riegrova 394/17, 779 00 Olomouc, Company ID: 19990341, is the data controller within the meaning of Regulation (EU) 2016/679 (GDPR).

6.2. Personal data of customers who are natural persons is processed for the following purposes:

• processing reservations and providing services,
• fulfilling legal obligations (e.g. accounting, tax regulations),
• legitimate interest of the controller (e.g. protection of rights),
• sending marketing communications, if the customer has given explicit consent.

6.3. The following personal data is processed in particular: name, surname, address, email, telephone number, and, in the case of business persons, company ID and VAT number; plus reservation and payment data.

6.4. Personal data is processed only for the time necessary to fulfil the stated purposes, but no longer than:

• 10 years after the end of the contractual relationship (for legal reasons),
• or until consent to processing is withdrawn (in the case of sending newsletters).

6.5. In accordance with GDPR, the customer has the right:

• to access their personal data,
• to rectification or erasure,
• to restriction of processing,
• to object to processing,
• to data portability,
• and to lodge a complaint with the Office for Personal Data Protection.

6.6. Personal data is processed by the Company’s employees or by data processors (e.g. IT or accounting service providers) based on contracts in accordance with legal regulations.

6.7. Personal data is not transferred to third parties without the customer's consent, except for entities involved in processing the reservation (e.g. banks, payment intermediaries, transport providers) and only to the extent necessary.

6.8. The customer may revoke their consent to receive marketing communications at any time by clicking the unsubscribe link in the email or by contacting the Company at info@goldenpeacockresort.com.

7. Out-of-Court Dispute Resolution

7.1. In the event of a consumer dispute between the customer and the seller, the customer has the right to out-of-court dispute resolution.

7.2. The authority for out-of-court dispute resolution is the Czech Trade Inspection Authority (www.coi.cz).

7.3. This option applies only to customers who are consumers within the meaning of the law (B2C).

8. Discount Policy

8.1. The Company may offer customers discounts on the price of provided services in the form of marketing promotions, promo codes, or individual offers.

8.2. Discounts cannot be combined unless explicitly stated otherwise.

8.3. If a customer is entitled to multiple different discounts for the same service or stay, they must choose one specific discount to apply.

8.4. Discounts can only be applied before the reservation is paid. Once the contract is concluded and the price paid, discounts can no longer be applied retroactively.

8.5. The Company reserves the right to verify the legitimacy of the applied discount and, in case of unauthorized use, to adjust or cancel the reservation.

9. Final Provisions

9.1. These Terms and Conditions are valid and effective from 25 July 2025 and replace all previous versions.

9.2. The Company reserves the right to amend these Terms and Conditions. The new wording becomes effective on the day it is published on the website.

9.3. These Terms and Conditions are governed by the laws of the Czech Republic.
